If you actually lose your case then you are still liable to pay the legal costs of the other party. Your solicitor may have signed a no win, no fee contract but the opposing sides solicitor did not and will need paying for their time. This can turn out to be quite a hefty charge.

For this reason you can obtain something that is called ‘after-the-event’ insurance. This is an insurance policy that will pay the solicitors costs should you lose your case. The only problem with this is that you may think you have a good case but the insurance company may disagree. If the insurance company do not believe that your chances of success are high then they may refuse to grant the policy.

Should this happen then you will have to have a long think about whether to pursue the compensation claim or not. Should the unexpected happen and you lose your case, you will be responsible for the other parties legal costs. They may have had to hire experts to prove their case and these may also prove to have expensive fees.
