Drawbacks of a Contested Divorce over an Uncontested One

divorceA divorce can be either uncontested or contested. An uncontested divorce is a ‘no fault divorce’, for which an attorney is not indispensable.  The two persons can seek divorce privately after negotiating the issues face to face. This is one case, where no attorney is needed, but if the two persons cannot agree on every issue, an attorney should be hired to solve the disagreements.

The issues which comes under consideration in obtaining a divorce are the grounds for the divorce, visitation rights, payment of family debts, distribution of the assets, child support, alimony, children custody, educational expenses of the children, income tax etc.

The willing-for-divorce couple should solve all the issues before they finally file for an uncontested divorce. The court will provide an identification number also prescribe a trial time to solve the unsolved issues. But in case the couple fails to deal with the unsolved issues, contested divorce is considered.

The court will then negotiate all the issue in favor of the couple, so that they can avoid the hassles of a contested divorce. If still found unsolved, the court will expedite the hearing date and consider the grounds of the divorce.
